NOTICE OF SALE OF FARM LAND BY SEALED BID

Public Notice is given that Owners, Judith K. Kimmel, Barbara J. Waldrop, Sonja R. Music, Sherry S. Harmon, and Spencer D. Rosborough, are accepting sealed bids for the sale of approximately 109.67 acres located in Petty Township, Lawrence County, Illinois, and more particularly described as follows:

PIN# 08-000-839-00 Approximately 77.67 acres

PIN# 08-000-840-00 Approximately 32 acres

The property is being sold as one tract. Purchaser must NOT bid on a per acre basis. All bids must state the purchase price for the entire tract.

Prospective bidders may tour the property with a representative of Sellers upon 24 hours’ notice and signing a liability waiver.

The terms of the sale shall require Purchaser to execute a Contract for Sale of Real Estate and deposit with Sellers 10% of the purchase price in certified funds within seven (7) days of acceptance of the bid, with the balance of the purchase price due at closing. The real estate closing shall occur within forty-five (45) days of acceptance of the bid.

All bids must be submitted and received on or before Monday, April 26, 2021 at 5:00 p.m. All bids must be submitted in writing and submitted to the attention of Brady R. Waldrop, of Gosnell, Borden, Enloe, Sloss & McCullough. Ltd., at his office located at 815 12th Street, P.O. Box 737, Lawrenceville, Illinois 62439.

All bids shall be received on or before that date and time. The bids should be submitted in a sealed envelope and marked “Bid for land owned by Judith K. Kimmel, Barbara J. Waldrop, Sonja R. Music, Sherry S. Harmon, and Spencer D. Rosborough” and include the amount bid for the entire tract, the bidder’s name, address and telephone number. The successful bidder will be notified in writing of acceptance of such bid. Sellers reserve the right to reject any and all bids for any reason and the right to waive any and all formalities or irregularities in the bidding process.

Each bid will be subject to the following terms and conditions:

I. If a bid is accepted, the sale will be subject to the following terms and conditions:

a. Sellers shall furnish Purchaser, in advance of closing, an Owner’s Commitment for Title Insurance covering only the surface estate of the premises evidencing merchantable title in the amount of the purchase price.

b. Permissible exceptions shall include:

(1) The lien of general real estate taxes for the year 2020 due and payable in 2021 and for the year 2021 due and payable in 2022 and any special assessments.

(2) All zoning laws and building ordinances, roads and highways, if any.

(3) Usual easements and rights-of-way, if any.

(4) Usual covenants and restrictions of record, if any.

(5) Sellers convey any and all mineral interests they may own, but the sale will be subject to any and all prior reservations and exceptions or conveyances of coal, oil, gas, and other minerals and any leasehold rights arising thereby.

(6) The real estate is being sold subject to a farm crop share lease which will expire at the end of the crop year 2021.

IV. Routine and customary closing costs shall be paid and apportioned between Sellers and Purchaser, as is customary.

V. The real estate is being sold “as is.”
